Terms of Service

Welcome to _app_name (hereinafter referred to as the "Platform" or the "App").

This Agreement is entered into by the _app_name team (the owner and operator of _app_name), the _app_name client, and you ("you" or the "user"); _app_name has zero tolerance for inappropriate content or malicious users.

By using _app_name, you agree to these Terms.

If you do not agree to any provision of these Terms, you must not use the Service.

1. _app_name Services

These Terms of Service apply to all users of _app_name services.

2. Usage Agreement

2.1. Compliance with the Terms of Use

Your access to and use of our services are subject to these Terms of Use, your acceptance of the Platform's Privacy Policy, and all applicable laws, rules, and regulations governing our services.

2.2. Age Requirements

Although we provide content suitable for children, children should not use our services without the supervision and approval of a parent or guardian.

If you are under 12 years of age (or under the legal age of majority in your state, region, or country of residence), you must not register for or use our services or provide us with your personal data.

2.3. Binding Agreement

By registering for our services or accessing any content, you enter into a binding agreement with us and confirm that all information you provide is and will remain true, accurate, and complete, and that you are:

a. At least 18 years old (or the legal age of majority in your state, region, or country of residence) and agree to be bound by these Terms of Use and other agreements; or

b. At least 12 years old but under 18 (or under the legal age of majority in your state, region, or country of residence), and your parent or guardian has consented to your use of our services and access to any content.

Such consent also includes acceptance of these Terms of Use and other agreements on your behalf, including any changes you make to your account.

2.4. Account Operation and Use

You are responsible for all use of your account, including use by other members of your household or your acquaintances.

By allowing others to access your account or create profiles within it, you agree to ensure that they comply with these Terms of Use and other agreements, and you accept responsibility for their activities when using our services.

2.5. Accurate Data

You represent and warrant that all data and information you provide to us are accurate in all respects, and you agree to promptly update your registration data whenever necessary so that it remains accurate.

2.6. Software Updates

By downloading, installing, or using our services, you agree to receive automatic software updates where applicable.

2.7. Malware

You must not knowingly or recklessly introduce viruses or other harmful components; tamper with, impair, or damage our services or connected networks; or interfere with any person's or entity's use or enjoyment of our services.

3. User Content

3.1. Definition. "User Content" means any content uploaded, posted, or transmitted (collectively, "posted") by a user to the Service, including but not limited to text.

User Content does not include content provided by the Company to users through the Service ("Company Content"), which means all content provided by the Company through the Service, including but not limited to text and interactive features.

3.2. No Pre-Screening of User Content. Users may post User Content to or transmit it through the Service.

Although we endeavor to ensure that all User Content complies with our Community Guidelines, which are available in the App, we do not pre-screen User Content submitted or publicly posted by users.

However, with or without notice, we reserve the right to remove, prohibit, or temporarily block User Content that (i) we believe violates these Terms, our Community Guidelines, or applicable law, or (ii) is the subject of a complaint from another user.

Because we cannot review all User Content, we cannot guarantee its accuracy, completeness, authenticity, appropriateness, or quality.

Accordingly, you use or rely on User Content at your own risk.

3.3. Ownership of User Content; License. You own and retain the rights to the User Content that you post or display on or through the Service.

However, you grant us a worldwide, transferable, sublicensable, royalty-free license to reproduce, distribute, publicly display, transmit, make derivative works available to the public through any media or format now known or later developed, and otherwise develop and use all User Content that you post or make available through the Service for (i) advertising, marketing, and promoting the Company and the Service; (ii) displaying and sharing your User Content with other users; and (iii) providing the Service under these Terms.

If you terminate your account after posting or delete any User Content from the Service, the license for that User Content will permanently and irrevocably terminate.

You also grant us, our affiliates, and our business partners an unrestricted, worldwide, royalty-free license and the right to use your username and image to identify you as the source of User Content.

You must not post through the Service any User Content that you consider confidential or proprietary.

Any User Content you post, make available through the Service, or otherwise send to us will be treated as non-confidential and non-proprietary and may be processed and used by us under these Terms without further notice or liability.

The authorization in this section includes, without limitation, the royalty-free right to reproduce your User Content, meaning that we may use it without paying royalties to you or any third party involved in its creation.

3.4. User Content Restrictions. When posting User Content to the Service, you must comply with the following restrictions:

(i) You must own the User Content that you post or make available through the Service or have the right to grant the license described in these Terms;

(ii) User Content that you post or use through the Service must not infringe any person's privacy, publicity, copyright, contractual, intellectual property, or other rights;

(iii) Posting your User Content must not require us to obtain any additional license from, pay royalties, fees, compensation, or other amounts to, or provide attribution to any third party; and

(iv) Posting your User Content must not cause you to breach any agreement with a third party.

3.5. Prohibited Content. You must not post User Content that we determine to be prohibited, including but not limited to:

(1) Pornographic or erotic content, including such content in icons, titles, or descriptions.

We maintain a zero-tolerance policy for child sexual abuse material.

If we discover User Content containing child sexual abuse material, we will immediately report it to the relevant authorities and delete the submitting user's account;

(2) Violent or bullying content, including material that threatens, harasses, or bullies another user or third party; depicts violence, gratuitous harm, or harm directed at any person, place, or property; or incites violence, including suicide;

(3) Hate speech that promotes prejudice, discrimination, hatred, intolerance, or racism, or targets an individual or group, based on race or ethnicity, religion, disability, gender, age, nationality, veteran status, sexual orientation, or gender identity;

(4) Sensitive-event content that may be regarded as exploiting or showing insufficient sensitivity toward natural disasters, atrocities, conflicts, deaths, or other tragic events;

(5) Illegal-activity content, including use of the Service for any unlawful purpose, such as stalking or sexually exploiting any user; and

(6) Content that infringes intellectual property or other third-party rights, including copyrights, trademarks, privacy rights, and publicity rights.

3.6. Term and Termination.

These Terms take effect on the date you first use the Service and continue until terminated by you or us.

4. Access to _app_name

Subject to your compliance with these Terms of Service, _app_name grants you a license to use the Service, provided that:

(1) Your use of the Service is limited to personal, non-commercial purposes;

(2) You must not copy, transfer, provide access to, reproduce, or distribute any part of the Service without prior written authorization from _app_name;

(3) You must not attempt to reverse engineer, modify, or alter any part of the Service; and

(4) You must comply with all other terms and conditions of these Terms of Service.

5. Reporting Sensitive Content

(1) _app_name has zero tolerance for inappropriate content or malicious users.

(2) _app_name reviews content to identify pornographic material.

Any user who posts pornographic content in a profile, background, or chat room will be blocked within 24 hours.

(3) _app_name administrators reserve the right to monitor and investigate.

A user's account may be banned depending on the severity of the conduct.

6. User Status Submissions

6.1. The _app_name Service allows you and other users to submit status text and other communications ("User Status Submissions") and allows those submissions to be hosted, shared, and/or published.

As described below, you retain all rights in your User Status Submissions.

You understand that _app_name does not guarantee the confidentiality of any submission, whether or not it is published.

6.2. You are solely responsible for your User Status Submissions and the consequences of posting or publishing them.

Because _app_name acts only as a repository for data, user-submitted statuses do not necessarily represent the views or opinions of _app_name, and _app_name makes no warranty regarding the validity, accuracy, or legal status of any status.

For User Status Submissions, you represent and warrant that (i) you own or have obtained all licenses, rights, consents, and permissions necessary to use and authorize _app_name to use all patents, trademarks, trade secrets, copyrights, or other proprietary rights required to include and use your User Status Submissions in connection with the Service and these Terms; and

(ii) you have obtained the written consent, release, and/or permission of each identifiable individual to include and use that person's name or likeness in connection with the Service and these Terms.

For clarity, you retain all rights in your User Status Submissions, but you must first possess those rights.

By submitting User Status Submissions to _app_name, however, you grant _app_name a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform those submissions in connection with the _app_name Service and the business of _app_name and its successors, including promotion and redistribution of all or part of the Service and its derivative works in any media format and through any media channel.

You also grant each subscriber to the _app_name Service a non-exclusive license to access your User Status Submissions through the Service, email, and mobile devices and to display portions of those submissions as permitted by the Service's functionality and these Terms.

The foregoing license terminates when you remove or delete your User Status Submissions from the _app_name Service.

6.3. When submitting User Status Submissions, you further agree not to:

(1) Submit material protected by copyright, trade secret, or other third-party proprietary rights, including privacy and publicity rights, unless you own those rights or have permission from the owner to post the material and grant _app_name all license rights granted under these Terms;

(2) Publish falsehoods or misrepresentations that could damage _app_name or any third party;

(3) Submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, encourages conduct constituting a criminal offense, gives rise to civil liability, violates any law, or is otherwise inappropriate;

(4) Post advertisements or commercial solicitations;

(5) Impersonate another person;

(6) Send or store material containing malware, viruses, worms, Trojan horses, or other harmful computer code, files, scripts, agents, or programs;

(7) Interfere with or disrupt the integrity or performance of the Service or its data; or

(8) Attempt to gain unauthorized access to the Service or its related systems or networks.

6.4. Adult content must be labeled as such.

_app_name does not endorse any User Status Submission or any opinion, recommendation, or advice expressed in it and expressly disclaims all liability related to User Status Submissions.

_app_name does not permit copyright infringement or other intellectual property infringement through the Service and will remove infringing content and User Status Submissions upon receiving proper notice.

_app_name reserves the right to remove content and User Status Submissions without prior notice.

_app_name may also terminate a user's access to the Service if the user is determined to be a repeat infringer or for any or no reason, including because the user is considered objectionable.

A repeat infringer is a user who has been notified of infringing activity more than once and/or whose User Status Submissions have been removed from the site more than twice.

An objectionable person is anyone determined to be objectionable by an authorized employee, agent, sub-agent, or super-agent of _app_name, whether or not that determination is made maliciously.

Beyond copyright and intellectual property infringement, _app_name reserves the right to decide whether content or User Status Submissions are appropriate and comply with these Terms, including content that is excessively long or of limited interest.

_app_name may, at any time and in its sole discretion, remove such User Status Submissions and/or terminate a user's access for uploading material in violation of these Terms, without prior notice.

6.5. You understand that when using the _app_name Service, you will encounter User Status Submissions from various sources and that _app_name is not responsible for their accuracy, usefulness, safety, or intellectual property rights.

You further understand and acknowledge that you may encounter inaccurate, offensive, indecent, or objectionable User Status Submissions; you waive any legal or equitable rights or remedies you may have against _app_name regarding such content; and, to the fullest extent permitted by law, you agree to indemnify and hold harmless _app_name, its owners and operators, affiliates, and/or licensors from all matters relating to your use of the site.

6.6. _app_name permits you to link to material on the Service solely for personal, non-commercial purposes.

Commercial versions may be available under separate licenses and terms.

_app_name reserves the right to discontinue any aspect of the _app_name Service at any time.

You agree that your use of the _app_name Service is entirely at your own risk.

To the fullest extent permitted by law, _app_name and its officers, directors, employees, and agents disclaim all express and implied warranties relating to the Service and your use of it.

_app_name makes no warranty or representation regarding the accuracy or completeness of the Service's content and will not be liable for:

(I) Errors, mistakes, or inaccuracies in content;

(II) Personal injury or property damage of any nature resulting from your access to or use of our Service;

(III) Unauthorized access to or use of our servers or any personal and/or financial information stored on them;

(IV) Any interruption or cessation of transmission to or from our Service;

(V) Viruses, worms, Trojan horses, or similar malicious programs transmitted to or through our Service by any third party; or

(VI) Errors or omissions in any content, or loss or damage resulting from the use of content posted, emailed, transmitted, or otherwise made available through the _app_name Service.

_app_name does not warrant, endorse, guarantee, or assume responsibility for any third-party product or service advertised or offered through the _app_name Service, a hyperlinked website, a User Status Submission, or another advertisement, and _app_name will not be a party to or responsible for monitoring any transaction between you and a third-party product or service provider.

As with the purchase of any product or service through any medium or environment, you should use your best judgment and exercise caution where appropriate.

Once again, the Service is for entertainment purposes only.

7. Limitation of Liability

Under no circumstances will _app_name, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from:

(1) Errors, mistakes, or inaccuracies in content;

(2) Personal injury or property damage of any nature resulting from your access to or use of our Service;

(3) Unauthorized access to or use of our secure servers or any personal and/or financial information stored on them;

(4) Any interruption or cessation of transmission;

(5) Viruses, worms, Trojan horses, or similar malicious programs that may be transmitted by a third party; or

(6) Errors or omissions in any content, or loss or damage resulting from the use of content posted, emailed, transmitted, or otherwise made available through the _app_name client or its content.

This limitation applies whether liability is based on warranty, contract, tort, or any other legal theory, and whether or not the Company has been advised of the possibility of such damages.

The foregoing limitation of liability applies to the extent permitted by the law of the applicable jurisdiction.

You expressly acknowledge that _app_name is not responsible for defamatory, offensive, or unlawful conduct in user submissions or by any third party and that you bear all resulting risk.

You agree not to use the product while operating a motor vehicle, for time-critical or emergency services or events, or for any operation that could result in injury, death, or financial loss.

_app_name does not represent that the _app_name Service is appropriate or available in every location.

Anyone who accesses or uses _app_name from another jurisdiction does so voluntarily and is responsible for complying with local law.

8. Termination of Service

You may terminate all services by deleting your account and the App from the mobile device on which it is installed.

If you wish to remove User Content from the Service, you may do so using the features provided in the App; however, removing or deleting User Content does not terminate these Terms.

If you violate these Terms, any terms of our App, or the rights of a third-party copyright owner, we may restrict, suspend, or terminate these Terms and your access to all or any part of the Service at any time, without notice or liability.

We will make reasonable efforts to notify you of such termination through the email address associated with your account or when you next attempt to access your account, as appropriate, although notification may not always be possible.
